What Is a Hard Title?

A hard title (also known as a Cadastral Title) is issued by the Ministry of Land Management, Urban Planning and Construction (MLMUPC) and registered at the national level. It provides the highest level of legal ownership protection in Cambodia.

Step-by-Step Hard Title Transfer Process

1. Prepare and Sign the Transfer Application

Both the buyer and seller must thumbprint and sign an official transfer application form known as the “Venti Definitive”.

Along with this form, relevant documents must be submitted. The exact requirements depend on whether the buyer or seller is an individual or a company, but commonly include:

  • Original hard title
  • National ID or passport
  • Marriage certificate (if married)
  • Single status certificate (if unmarried)
  • Company documents (if applicable)

Example: If the seller is married, the spouse must also provide consent and documentation, even if the title is in the seller's name only.

2. Submission to the Cadastral Office

Once completed, the application and documents are submitted to the local Cadastral Office.

  • Processing time: 30–45 days
  • Outcome: Issuance of a tax payment order

3. Stamp Duty Tax Payment

Using the tax payment order, the buyer applies for stamp duty tax at the General Department of Taxation.

  • Outcome: Official tax payment receipt

Example: If the declared property value is USD 100,000, the stamp duty payable is USD 4,000.

4. Final Submission and Title Issuance

After stamp duty is paid, the full document set is returned to the Cadastral Office for final processing.

  • Processing time: Approximately 2 weeks
  • Outcome: A new hard title issued under the buyer’s name
  • At this stage, the ownership transfer is legally complete.

  • Processing/service fee: covers document handling between the Cadastral Office and Tax Department
  • Public service fee (Cadastral Office)

  • Processing fees (items 1–3 combined): USD 1,200–1,800, depending on the property and parties involved
  • Using a lawyer: usually an additional USD 300–500 on top of processing fees
  • Stamp duty tax: 4% of the declared property value
