Knowledge of these important obligations will not only make transactions easier but also help everyone avoid unnecessary costs and penalties. This guide is designed to give you a basic understanding of obligations so you donโ€™t go blind into Cambodiaโ€™s property market.Overview of Property Taxes in Cambodia:Cambodia has a 0.1% Property Tax applied on Immovable PropertiesProperty Taxes must be paid every year around SeptemberProperties below $25,000 (100 Million KHR) are exempt from Property TaxAgricultural land, industrial, and state-owned lands are exempt from Property TaxLocal tax offices have a valuation matrix called the Tax Base for specific property types and sizes within their jurisdiction, this factors into the final Property Tax that has to be paid. How much is Property Tax in Cambodia?Property taxes in Cambodia are officially referred to as โ€œTax on Immovable Propertyโ€ (TOIP) and levies an annual tax of 0.1% on properties that have a value of more than $25,000 (100 million KHR). The term โ€œImmovable Propertyโ€ includes plots of land, infrastructure on land, and buildings.NOTE: Properties valued under $25,000 are exempt from paying the Property TaxProperty Tax is generally calculated by the following formula:(80%*(tax base)-$25,000)*0.1% = Property TaxSample calculation:Mr. Ivanov owns a reinforced concrete building with 3 floors with each floor having 15m x 25m of floor size. Mr. Ivanov consulted with the Property Valuation Commission and retrieved the following Tax Base relevant to the property:Land price per sqm$1,000Ground floor per sqm$250First-floor per sqm$200Second-floor per sqm$150ย Mr Ivanovโ€™s 3-storey buildingโ€™s property tax can then be calculated like this:Land price25m x 40m x $1,000$1,000,000Ground floor15m x 25m x $250$93,750First-floor15m x 25m x $200$75,000Second-floor15m x 25m x $150$56,250ย Tax Base of Mr Ivanovโ€™s property: $1,225,000. Letโ€™s take this Tax Base and apply the Property Tax formula.(80%*($1,225,000)-$25,000)*0.1% = $955 will be the Property Tax Mr Ivanov has to pay every year for his 3-storey building. What is a Tax Base and How is it calculated?A Tax Base is a price per square metre for a certain property type assessed by the Ministry of Economy and Finance. Transfer/Stamp Tax)The Registration Tax (a.k.a. Transfer/Stamp Tax) is the tax paid for transferring property ownership or right occupancy of land that does not have a standing building on top. This is a 4% tax derived from the Tax Base of the property in question. This property-related tax is crucial to know if youโ€™re someone looking to buy or sell property in Cambodia. Sellers are generally the ones shouldering the transfer tax, though it can go either way - this is best discussed in clear terms with whoever you may be transacting with.NOTE: Properties transferred to direct kin via inheritance are exempted from the Registration Tax. The relevant Prakas states โ€œtransfers between spouses, parents, and children, or grandparents and grandchildren, will no longer require this taxโ€Calculation formula: (Tax Base*4%) = Registration TaxSample calculation: ($100,000*4%) = $4,000 Registration TaxProperty Tax on Rental PropertyLocals and foreigners who own and rent out their properties need to pay Rental/Income Tax every year. A foreign investor who buys property here and rents it out needs to pay 14% of the gross rate annually while locals have to pay 10%.Property Tax on Unused LandThe Unused Land Tax is a 2% tax levied on bare plots of land with no building constructed and abandoned landed properties in cities like Phnom Penh. The Unused Land Tax is determined by the Unused Land Appraisal Committee (ULAC).How is Property Tax paid in Cambodia?Property Taxes can be paid via local tax office branches or through ACLEDA Bank, Canadia Bank, Vattanac Bank, or Cambodia Public Bank. For already registered properties, taxpayers will only need the tax payment receipt of the previous year or their Property Tax Registration ID.For unregistered properties, owners must contact the local tax office their property is in. The following documents will be required for registration:Tax Form PT01 - a form issued by the General Department of Taxation (GDT) that asks owners to outline the specifics of their property.Tax Form PT02 - another form issued by the GDT which serves as a tax application form.National ID Card, Birth Certificate, or PassportResidence Book or Family Book or Residency LetterOther documents may be required depending on the status of those involved in the transaction. We highly encourage seeking legal assistance for more specific matters.Capital Gains Tax in CambodiaThe Capital Gains Tax in Cambodia is a flat 20% rate. The Capital Gains Tax was promulgated through Prakas 346 in April 2020 and was initially to be enacted in July 2020. However, the advent of COVID-19 delayed its implementation to January 2022 to keep Cambodia's property market activity going throughout the pandemic.Contrary to what most people perceive: The Capital Gains Tax in Cambodia is not exactly new; businesses in the Kingdom have always paid capital gains. The material difference now is that it applies to individuals, especially those looking to sell immovable property a.k.a. real estate. A more thorough discussion of Capital Gains Tax in Cambodia can be found here. The Capital Gains Tax in Cambodia can be calculated in 2 different ways:Actual Expense Deduction MethodThis method takes the sales proceeds and subtracts the expenses the seller made on that property to get the actual Capital Gains Tax to be paid. These deductibles can be the purchase cost, consulting fees, registration tax, commissions, and even advertising. These actual expenses are deducted from the sales proceeds and 20% of the difference will be the Capital Gains Tax to be paid. There are more applicable deductibles so we highly suggest you keep tabs on the expenses you made in your property if you are planning to sell in the future.Determination-Based Deduction MethodThis method takes 80% of the sales proceeds and subtracts it from the whole sales value. The result will be the Capital Gains and 20% of it will be the Capital Gains Tax to be paid. This method is highly beneficial for property owners who buy low and are planning to sell high.Capital Gains Tax in Cambodia is expected to be enforced by January 2022. Once the law is in effect, we highly encourage keeping tabs on your expenses on the property to properly assess which method applies best in your case.Looking for property in Cambodia? Sihanoukville ranks amongst top global holiday destinations for 2018
Sihanoukville ranks amongst top global holiday destinations for 2018

Realestate News
New York Times has released their starter kit for escaping into the world, namely, through releasing their renowned list of the โ€˜52 places to go in the worldโ€™. The beaches of Sihanoukville ranked at number 13 on the list amongst other top destinations such as New Orleans in Louisiana taking the top spot, followed by Colombia, and ย Basilicata in Italy. - see Realestate.com.kh's The Ultimate Guide To Sihanoukville for a complete overview of Sihanoukville. As the list eluded to, Cambodia has been notoriously famous for it's Angkor Wat Temples in Siem Reap - which still remain as the biggest tourist attraction in Cambodia. In 2015 Angkor Wat was labeled by Lonely Planet as the number one tourist destination in the world. However, adorned with white sand beaches, accessible islands, a host of developments and new infrastructure initiatives in play- allowing for ease of access to the seaside province- it seems that Sihanoukville's tourism potential is garnering well deserved global attention.Sihanoukville International Airport has been undergoing major renovations, whilst the construction of a new terminal promises to increase capacity to 500,000 passengers per year. Once completed, Sihanoukville Airport is set to be the kingdom's largest airport. Already new flight routes have been added, with ongoing international flights from China, Vietnam, and Malaysia.Further to this, Grand Union Group, the developer of Dara Sakor Seashore Resort Casino in Koh Kong received permission in 2017 to build another airport. Although Koh Kong is not directly in the province, it still represents another key point of access which is within a few hours driving distance to Sihanoukville.Construction is anticipated to commence on this airport in early 2018 and will involve a total investment of 500 million USD.In terms of the hotel scene- both on the shoreline and the multitude of surrounding islands, including the popular Koh Rong, Koh Rong Sanloem, Koh Russey and Krabey Island- this has exploded over the last few years.Of special note is Six Senses on Krabey Island, a mere 20-minute boat transfer south of Sihanoukville, and Alila Villas on Koh Russey, with both resorts opening in 2018. Both will offer the full island experience, with snorkeling, diving, and all other beach amenities for tourists to enjoy.ย ย Besides hotels, the potential for mixed-use and residential developments has caught the eye of major international developers. Dโ€™Seaview, Blue Bay, The SeaGate Suite, Royal Bayview and Sunshine Bay are amongst the major projects which are currently under construction- and will bring luxury facilities, and a new skyline to the province. In addition, infrastructure initiatives such as a direct highway between Phnom Penh and Sihanoukville improved internal roads, port expansions and Cambodia's largest Special Economic Zone (SEZ) are all factors contributing to Sihanoukville's status as a 'boomtownโ€™ for attracting both tourists and investors alike.ย  ย Search properties for sale in Sihanoukville and current properties for rent in Sihanoukville!

Choosing a Real Estate Agent: One Versus One Hundred

Property Buyers & Sellers Advice
When selling your home, should you stick with one real estate agent or list your property through multiple agents? Both options have clear advantages and disadvantages that sellers may want to consider before deciding.ย Listing with Multiple Agents:- If you want to make a quick sale, listing your property with multiple agents would seem like a logical choice. And thereโ€™s a good reason for that. You get more exposure. These professionals can utilize different avenues such as the newspapers, buyer networks and internet property listings to spread awareness for your property. More exposure means a gathered interest from a larger audience.- The downside to using multiple agents though is that youโ€™re working with a range of people and various sales strategies that are often times totally different from each other. This also entails that there are different degrees of understanding as to what type of buyers are qualified for the sale. This may mean the information about your property becomes different than you first intended as it travels between agents and their networks - which will mean the buyers they present areย not necessarily sold on the correct info. ย - Hiring multiple agents also means that negotiations will be done in isolation.ย The ones competing wonโ€™t be the buyers but the actual agents. This hurts your cause because you might find out too late that someone else may have made a higher offer.- There is also the risk of running into โ€œcommission cowboysโ€. These are self-professed private agents who will do anything to make a sale. This doesnโ€™t always get you the best buyers.Listing with an Exclusive Agent:- The thing about listing with an exclusive real estate agent is that their sales strategy โ€“ if itโ€™s the right strategy โ€“ it can save you a whole lot of time and effort. It focuses in on making sure that you get a good deal, with the right buyer without demanding too much. This also offers the agent more flexibility to adjust their strategy based on your needs and on the current marketโ€™s feedback.- You can hire a professional that specializes in your kind of property too. It is important to note that one effective person can outdo a hundred ineffective ones. Make sure you choose your agent wisely.- Having an exclusive real estate agent also makes it easier for the buyer. Buyers would rather think about their personal needs more than they think about which agent they should contact. Keeping everything singular eliminates any possibility of confusion and makes it more convenient for buyers to make an offer.- Exclusive agents also sometimes package property management services into the mix as a form of incentive. This is something you wonโ€™t get from multiple agents.- The downside to this is that information about your property is limited to the stream of influence your agent has. Your reach is much more contained.Want to learn more about how you can make money byย investing in real estate wisely?ย Get on Realestate.com.kh today!Ready to make a listing?ย Sign upย for an accountย with us now!

Vann Molyvann, considered the founder of the modern Khmer architecture, completed nearly 100 projects both nationally and abroad between 1956 and 1970. The impact of his architecture is felt around numerous corners of the Kingdom - with many still applauding his architectural style.Ms. Tri Lida from Re-Edge Architecture & Design refers to Molyvann as โ€œthe father of Cambodian architectureโ€ - holding a โ€œunique ability to incorporate Khmer style with natural elements, creating sustainable buildings where the air and sunshine flow from the inside out.โ€Some of Molyvannโ€™s most significant projects are the Independence Monument, the National Olympic Stadium, the Royal University of Phnom Penh, the Chaktomuk Conference Hall, Preah Suramarit National Theater, the Council of Ministers building and the State Palace in Chamkarmon โ€“ now the place of the Senate. There are also several of his projects which are less known by the general public; such as the stupas within the Royal Palace, the Kantha Bopha Hospital, the first Siem Reap airport and the pavilions and temples for the 2,500th anniversary of the Buddha.Aside from the many projects he completed within the Kingdom, Molyvann also worked on projects abroad such as the Exhibition Hall for the International Trade Fair in Osaka, Japan, the Exhibition Hall For the International Trade Fair of Zagreb, the Exhibition Hall at the International Trade Fair of Brno, Czechoslovakia, and the Exhibition at the Galleries Lafayette in Paris. However, when asked his most loved architectural projects, these are all national - although not all are still in existence: โ€œThe ones I love the most is the National Olympic Stadium and Preah Suramarit National Theater on Bassac in Phnom Penh. There are many other projects I was fond of, but unfortunately some of them have been replacedโ€‹ by new buildings or were destroyed,โ€ said Mr Molyvann. The demolition of old architecture is a recurrent issue in Cambodia, which the photo expert and owner of the โ€œAmazing Cambodiaโ€ photo archives, Mr Srin Sokmean, has likewise noted: โ€œIt is a great pain to witness those architectural heritages disappear one by one. I always question myself why they are destroyed and not suitably renovated.โ€This is what pushed him to produce a vintage photo collection book named โ€œCambodia: Half Century Then & Nowโ€ which aims to enable people to visualize the beauty of Cambodia in the past and how the current landscape has been modified. On top of this, Sokmean has a popular facebook page and blog demonstrating his collections of photography.ย โ€œI strongly believe that redecoration is the best option, because each building has its own attractive point. Development and architectural conservation need to go togetherโ€ he added.โ€œOld buildings are not always useless; instead they can be perfectly converted into museums, art galleries, boutique hotels or other amenities,โ€ he concludes. And Sokmean is not the only one trying to preserve national heritage via media platforms.ย Mrs. Teav Bandol of Image Printing also shares a similar concern that, โ€œduring development, many countries face the dilemma of whether to preserve or replace heritage buildings to give space for new development; sadly most countries choose the latter. Cambodia is no exception.โ€She continued, โ€œIt should not be destroyed but preserved. Both old and new architectural work must be kept in its place in order for the public to witness the evolution from one generation to another. Doing so will help us to preserve the national identity and maintain sustainable development.โ€With that in mind, Image Printing is planning to re-publish some books detailing Vann Molyvannโ€™s works in order to ensure his contributions reach the next generation.Bandol mentioned that the publication of these books are not just for the purpose of preserving Van Molyvannโ€™s buildings โ€“ but itโ€™s also โ€œa demonstration of intelligence, knowledge and innovation in the architecture industry - which is a good example for the new generation to follow.โ€โ€œMoreover, we cannot regain a building that was destroyed, but we can save every document for next generations,โ€ she concludes.Find the latestย real estate newsย on Realestate.com.kh

UBER Cambodia: launching soon?
UBER Cambodia: launching soon?

Realestate News
With Cambodiaโ€™s growth as an emerging economy in the global market, it is inevitable for new technological advancements to also penetrate through to different industries. One such industry though is the transport sector, where the country is slowly trying to catch up with its neighbors โ€“ specifically, in terms of transportation booking apps for mobility. But is the market really open to welcome new players in the industry or is it getting too crowded?Whoโ€™s willing to take a risk? While UBER may be a global phenomenon for bringing ease and comfort to millions of people worldwide, itโ€™s not the first of its kind to actually spring up in Cambodia. Previous startups have given this a go. These include Choice Taxi, Exnet Taxi Cambodia, PassApp Tax, and iTsumo. But the company doesnโ€™t seem any bit fazed.Just recently, David Van โ€“ Managing Director of Bower Group Asia โ€“ brought UBER representatives toย meet withย Cambodian Minister of Public Works & Transport Sun Chanthol to discuss proposals for their future launch. Although no details have been given yet regarding the official date of the launch, it looks like the company is in full gear to do it soon because this news comes only a two months after UBERโ€™sย first meetingย with the Cambodian Minister of Commerce Pan Sorasak.UBER CambodiaThe company may be coming in full force, but there are also concerns of UBER eventually collapsing, especially with news of them having pulled out fromย Chinaย in exchange for a 20% holding in its competitorโ€™s company, Didi. CNN also reports that UBER is pulling out fromย Denmarkย as well. If thatโ€™s any indication, then UBER may have troubles with the Cambodian Market.Despite this, a post from the ministry of Commerceย Facebook pageย says โ€œMr. Chan Park and Mr. Brian Shroder, the representatives of American worldwide online transportation network company called โ€˜UBERโ€™ said that they were very impressed with Cambodiaโ€™s new market. But at the same time, they need to understand more about economic situation, peopleโ€™s living standard, and other challenges first.โ€How will people accept UBER?According to Masahito Ambashi, Economist for the Economic Research Institute for Asean and East Asia, mentioned โ€œUBER is famous internationally, including in Cambodia. Consumers may try its services, as they are different from those of locals. If such trends occur, a bandwagon effect could be expected.โ€ And this could ultimately lead to UBERโ€™s success. In line with this, Ambashi adds that โ€œmore wealthy middle-income groups โ€“ which can afford to enjoy service consumption โ€“ are certainly emerging in Cambodia.โ€ This means that the number of people who can afford UBER rides are also increasing. The other question remains, can Uber challenge the local tuk tuk market? Tuk tuks are everywhere in the major cities of Cambodia and are never far away from people in need of transportation for very low prices. The great thing about emerging markets is its potential for growth. But along with it comes the risks investors have to take because its regulations and laws are not fully developed yet. So, whether UBER Cambodia succeeds or not will fully depend on how well they did their study and how well they market themselves to the people of Cambodia.Find the bestย real estate newsย on Realestate.com.kh

Sihanoukville is one of Cambodiaโ€™s premier tourist destinations and fastest growing cities, which has recently became a target for many property developers. Find out why Sihanoukville is Cambodiaโ€™s next real estate boom town...Some developers are focused on the tourism sector, which is attracting millions yearly due to the provinceโ€™s white sand beaches; others are looking to the residential realm - where modern accommodation is in demand for seasonal holiday makers, workers and managers for the Special Economic Zones within and around the city; and local Cambodia investors looking to buy their next dream home in Cambodiaโ€™s next up and coming city.Sihanoukville, in comparison to Phnom Penh and Siem Reap, presents a more extensive growth prospect for Cambodian property investors - due to the various fundamentals at play here: tourism is a strong pull for foreigners and affluent locals. The company is now focusing on the main building construction and the construction of the carpark underneath is now underway and right on schedule. Camhomes believes in: choosing the best quality materials for the development and is making all the necessary controls in order to ensure long lasting quality of each and every unit. Cambodiaโ€™s real estate: a more transparent market with NC Max World Co. Ltd

Realestate News
In highly competitive and unregulated markets such as Cambodia; few agents are working as hard as NC Max World Co., Ltd. to bring more transparency and fair practice to their industry.Realestate.com.kh met up with Mr. Toko Kobayashi, Chairman & CEO of NC Max World Co. Ltd.Mr. Kobayashi, originally from Japan, has been operating real estate businesses for over thirty years, gaining invaluable experience in crucial markets such as the USA, Japan, Macao, Thailand, Europe and Cambodia. When asked why he chose Cambodia, Mr. Kobayashi informed us that โ€œCambodia is currently offering significant investment opportunitiesโ€ and that he believes this trend will continue to rise over the upcoming years. The prosperity of the local real estate market has also been verified by the ASEAN Investment Report, which stated that between January and August 2016, real estate foreign direct investment reached $7.2 billion.Mr. Kobayashi has also revealed that Cambodia offers a luxurious yet affordable lifestyle, which has been attracting an ever increasing number of expats searching for better quality of life over the past several years. This is also reflected within the Global Retirement Index, in which Cambodia ranked first among 23 countries for having the lowest cost of living. Due to his extensive experience across the international markets, we asked Mr. Kobayashi to draw comparison on how he felt about the local market. โ€œCambodia displays very weak regulations when it comes to professional conduct in real estate, compared to the other countries I have worked inโ€, says Mr. Kobayashi. In Cambodia, the absence of certified accredited license requirements, makes anyone eligible to become an agent and establish a real estate company. This in turn has contributed to the manifestation of a fairly sinister environment, where expats often fall victim to scams, inflated prices or mal-practice. โ€œPeople often enter into real estate thinking that theyโ€™ll become rich quickly, but they fail to understand that in reality the average time it takes for an agent to sell their first property is approximately six to twelve months. This span of time, whereby the agent is unable to earn a commission, pushes those in for a quick buck to operate without integrity.โ€ says Mr. Kobayashi. His advice for all those considering real estate investments in the Kingdom, is to perform a thorough check before signing any agreements or making any payments. As a professional with decades of experience, Mr. Kobayashi feels it is his duty and responsibility to operate with integrity and harbor good practice. The NC Max World Co. Ltd. team helps expats to find the right property based on their personal and financial needs.Although this is nothing new for the international markets, what differentiates Mr. Kobayashi from other Real Estate Agents operating in the Kingdom is that his team performs thorough due diligence reports on behalf of its clients, ensuring safe and reliable transactions. โ€œI am not looking for quick return, my strategy has always been to focus on establishing long term relationships and relying on positive word of mouth. Real Estate is usually one of the most significant purchases we make in our lifetime, therefore we have a duty to display the upmost integrity and honesty with every single one of our clients. After all, a happy customer is a returning customerโ€ says Mr Kobayashi. ย The team at NC Max World Co. Ltd, whose exceptional code of conduct forms the foundation of their business practice, are firm believers that a transparent, regulated market starts with the agents.
