The Kingdom of Cambodia is considered as one of the fastest-growing economies in the ASEAN region. According to the World Bank, Cambodia’s economy grew annually by 7 percent both in 2015 and 2016, and is forecasted to grow 6.9 percent year-on-year over the next three years.The Sihanoukville Autonomous Port is Cambodia’s only deep sea port and is the most important trade gateway driving the country’s economic growth. The port is strategically located in an ideal location in Cambodia’s  coastal southwest and is safe from typhoons, tsunamis, and other natural  disasters.Occupying about 125 hectares, Sihanoukville port was constructed in 1956 and started operations  in 1960. Currently,  the port has 8 terminal berths with a total length of 1,330 meters and is equipped with modern cargo-handling equipment.Over the last five years, the amount of container throughput  increased by an average of 11% per year. In 2015, the port generated a total revenue of $49 million, nearly an 18% increase from  the $9 million generated in 2014.The Royal Government of Cambodia has recently designated the port as an  industrial development zone.  This port has seen great potential in expanding the trade between Cambodia and other countries in the ASEAN, Asia-Pacific rim and the rest of the world.Sihanoukville port has entered into an IPO to further improve its business prospects. Gaining a basic understanding of property taxes in Cambodia is important for property owners, sellers, and buyers in the country. Knowledge of these important obligations will not only make transactions easier but also help everyone avoid unnecessary costs and penalties.This guide is designed to give you a basic understanding of obligations so you don’t go blind into Cambodia’s property market.Overview of Property Taxes in Cambodia:Cambodia has a 0.1% Property Tax applied on Immovable PropertiesProperty Taxes must be paid every year around SeptemberProperties below $25,000 (100 Million KHR) are exempt from Property TaxAgricultural land, industrial, and state-owned lands are exempt from Property TaxLocal tax offices have a valuation matrix called the Tax Base for specific property types and sizes within their jurisdiction, this factors into the final Property Tax that has to be paid.How much is Property Tax in Cambodia?Property taxes in Cambodia are officially referred to as “Tax on Immovable Property” (TOIP) and levies an annual tax of 0.1% on properties that have a value of more than $25,000 (100 million KHR). The term “Immovable Property” includes plots of land, infrastructure on land, and buildings.NOTE: Properties valued under $25,000 are exempt from paying the Property TaxProperty Tax is generally calculated by the following formula:(80%*(tax base)-$25,000)*0.1% = Property TaxSample calculation:Mr. Ivanov owns a reinforced concrete building with 3 floors with each floor having 15m x 25m of floor size. Let’s take this Tax Base and apply the Property Tax formula.(80%*($1,225,000)-$25,000)*0.1% = $955 will be the Property Tax Mr Ivanov has to pay every year for his 3-storey building.What is a Tax Base and How is it calculated?A Tax Base is a price per square metre for a certain property type assessed by the Ministry of Economy and Finance. Transfer/Stamp Tax)The Registration Tax (a.k.a. Transfer/Stamp Tax) is the tax paid for transferring property ownership or right occupancy of land that does not have a standing building on top. This is a 4% tax derived from the Tax Base of the property in question.This property-related tax is crucial to know if you’re someone looking to buy or sell property in Cambodia. Sellers are generally the ones shouldering the transfer tax, though it can go either way - this is best discussed in clear terms with whoever you may be transacting with.NOTE: Properties transferred to direct kin via inheritance are exempted from the Registration Tax. The relevant Prakas states “transfers between spouses, parents, and children, or grandparents and grandchildren, will no longer require this tax”Calculation formula: (Tax Base*4%) = Registration TaxSample calculation: ($100,000*4%) = $4,000 Registration TaxProperty Tax on Rental PropertyLocals and foreigners who own and rent out their properties need to pay Rental/Income Tax every year. A foreign investor who buys property here and rents it out needs to pay 14% of the gross rate annually while locals have to pay 10%.Property Tax on Unused LandThe Unused Land Tax is a 2% tax levied on bare plots of land with no building constructed and abandoned landed properties in cities like Phnom Penh. The Unused Land Tax is determined by the Unused Land Appraisal Committee (ULAC).How is Property Tax paid in Cambodia?Property Taxes can be paid via local tax office branches or through ACLEDA Bank, Canadia Bank, Vattanac Bank, or Cambodia Public Bank. For already registered properties, taxpayers will only need the tax payment receipt of the previous year or their Property Tax Registration ID.For unregistered properties, owners must contact the local tax office their property is in. The following documents will be required for registration:Tax Form PT01 - a form issued by the General Department of Taxation (GDT) that asks owners to outline the specifics of their property.Tax Form PT02 - another form issued by the GDT which serves as a tax application form.National ID Card, Birth Certificate, or PassportResidence Book or Family Book or Residency LetterOther documents may be required depending on the status of those involved in the transaction. We highly encourage seeking legal assistance for more specific matters.Capital Gains Tax in CambodiaThe Capital Gains Tax in Cambodia is a flat 20% rate. The Capital Gains Tax was promulgated through Prakas 346 in April 2020 and was initially to be enacted in July 2020. However, the advent of COVID-19 delayed its implementation to January 2022 to keep Cambodia's property market activity going throughout the pandemic.Contrary to what most people perceive: The Capital Gains Tax in Cambodia is not exactly new; businesses in the Kingdom have always paid capital gains. The material difference now is that it applies to individuals, especially those looking to sell immovable property a.k.a. real estate. A more thorough discussion of Capital Gains Tax in Cambodia can be found here.The Capital Gains Tax in Cambodia can be calculated in 2 different ways:Actual Expense Deduction MethodThis method takes the sales proceeds and subtracts the expenses the seller made on that property to get the actual Capital Gains Tax to be paid. These deductibles can be the purchase cost, consulting fees, registration tax, commissions, and even advertising. These actual expenses are deducted from the sales proceeds and 20% of the difference will be the Capital Gains Tax to be paid.There are more applicable deductibles so we highly suggest you keep tabs on the expenses you made in your property if you are planning to sell in the future.Determination-Based Deduction MethodThis method takes 80% of the sales proceeds and subtracts it from the whole sales value. The result will be the Capital Gains and 20% of it will be the Capital Gains Tax to be paid. This method is highly beneficial for property owners who buy low and are planning to sell high.Capital Gains Tax in Cambodia is expected to be enforced by January 2022. New York Times has released their starter kit for escaping into the world, namely, through releasing their renowned list of the ‘52 places to go in the world’. In 2015 Angkor Wat was labeled by Lonely Planet as the number one tourist destination in the world.However, adorned with white sand beaches, accessible islands, a host of developments and new infrastructure initiatives in play- allowing for ease of access to the seaside province- it seems that Sihanoukville's tourism potential is garnering well deserved global attention.Sihanoukville International Airport has been undergoing major renovations, whilst the construction of a new terminal promises to increase capacity to 500,000 passengers per year. Once completed, Sihanoukville Airport is set to be the kingdom's largest airport. Already new flight routes have been added, with ongoing international flights from China, Vietnam, and Malaysia.Further to this, Grand Union Group, the developer of Dara Sakor Seashore Resort Casino in Koh Kong received permission in 2017 to build another airport. Although Koh Kong is not directly in the province, it still represents another key point of access which is within a few hours driving distance to Sihanoukville.Construction is anticipated to commence on this airport in early 2018 and will involve a total investment of 500 million USD.In terms of the hotel scene- both on the shoreline and the multitude of surrounding islands, including the popular Koh Rong, Koh Rong Sanloem, Koh Russey and Krabey Island- this has exploded over the last few years.Of special note is Six Senses on Krabey Island, a mere 20-minute boat transfer south of Sihanoukville, and Alila Villas on Koh Russey, with both resorts opening in 2018. Both will offer the full island experience, with snorkeling, diving, and all other beach amenities for tourists to enjoy.  Besides hotels, the potential for mixed-use and residential developments has caught the eye of major international developers. A groundbreaking took place on Mong Rithy Street, Corner Road 1003 at Khan Sen Sok, surrounded by a group of workers and engineers, still actively working. This new construction site will soon be home to the first  wholesale supermarket in the country, known as Makro.According to Cambonomis, Makro supermarket will be built on an area of approximately 5 hectares with a height of 2 floors. It will be located in Sen Sok district, near Aeon Mall 2 (AEON), Japan supermarket.The upcoming supermarket is a joint venture between the company, LYP Group, which owns 30 percent., And CP Group owns 70 percent. This project will employ over 200 employees, working for the rising shopping mall.The local media have reported that yesterday's (29th of May) groundbreaking ceremony, the Mayor of Phnom Penh Mr Pa Socheatvong said "The establishment of supermarkets are within the government’s project. It's good to know when we have an upcoming wholesale supermarket so that the selling price of goods will not changing too fast, avoiding inflation"Makro is set to be the largest warehouse shop in the Kingdom which will bring Thai products to local consumers.In the past years Cambodia has seen many international projects of shopping centers coming into the market; and after the Japanese investments of AEON Mall and AEON Mall 2, it is now the turn of the Thai CP Group. Vann Molyvann, considered the founder of the modern Khmer architecture, completed nearly 100 projects both nationally and abroad between 1956 and 1970. The impact of his architecture is felt around numerous corners of the Kingdom - with many still applauding his architectural style.Ms. Tri Lida from Re-Edge Architecture & Design refers to Molyvann as “the father of Cambodian architecture” - holding a “unique ability to incorporate Khmer style with natural elements, creating sustainable buildings where the air and sunshine flow from the inside out.”Some of Molyvann’s most significant projects are the Independence Monument, the National Olympic Stadium, the Royal University of Phnom Penh, the Chaktomuk Conference Hall, Preah Suramarit National Theater, the Council of Ministers building and the State Palace in Chamkarmon – now the place of the Senate.There are also several of his projects which are less known by the general public; such as the stupas within the Royal Palace, the Kantha Bopha Hospital, the first Siem Reap airport and the pavilions and temples for the 2,500th anniversary of the Buddha.Aside from the many projects he completed within the Kingdom, Molyvann also worked on projects abroad such as the Exhibition Hall for the International Trade Fair in Osaka, Japan, the Exhibition Hall For the International Trade Fair of Zagreb, the Exhibition Hall at the International Trade Fair of Brno, Czechoslovakia, and the Exhibition at the Galleries Lafayette in Paris.However, when asked his most loved architectural projects, these are all national - although not all are still in existence: “The ones I love the most is the National Olympic Stadium and Preah Suramarit National Theater on Bassac in Phnom Penh. There are many other projects I was fond of, but unfortunately some of them have been replaced​ by new buildings or were destroyed,” said Mr Molyvann.The demolition of old architecture is a recurrent issue in Cambodia, which the photo expert and owner of the “Amazing Cambodia” photo archives, Mr Srin Sokmean, has likewise noted: “It is a great pain to witness those architectural heritages disappear one by one. I always question myself why they are destroyed and not suitably renovated.”This is what pushed him to produce a vintage photo collection book named “Cambodia: Half Century Then & Now” which aims to enable people to visualize the beauty of Cambodia in the past and how the current landscape has been modified. On top of this, Sokmean has a popular facebook page and blog demonstrating his collections of photography. “I strongly believe that redecoration is the best option, because each building has its own attractive point. Development and architectural conservation need to go together” he added.“Old buildings are not always useless; instead they can be perfectly converted into museums, art galleries, boutique hotels or other amenities,” he concludes.And Sokmean is not the only one trying to preserve national heritage via media platforms. Mrs. Teav Bandol of Image Printing also shares a similar concern that, “during development, many countries face the dilemma of whether to preserve or replace heritage buildings to give space for new development; sadly most countries choose the latter. Cambodia is no exception.”She continued, “It should not be destroyed but preserved. Both old and new architectural work must be kept in its place in order for the public to witness the evolution from one generation to another. Doing so will help us to preserve the national identity and maintain sustainable development.”With that in mind, Image Printing is planning to re-publish some books detailing Vann Molyvann’s works in order to ensure his contributions reach the next generation.Bandol mentioned that the publication of these books are not just for the purpose of preserving Van Molyvann’s buildings – but it’s also “a demonstration of intelligence, knowledge and innovation in the architecture industry - which is a good example for the new generation to follow.”“Moreover, we cannot regain a building that was destroyed, but we can save every document for next generations,” she concludes.Find the latest real estate news on Realestate.com.kh

But is the market really open to welcome new players in the industry or is it getting too crowded?Who’s willing to take a risk?While UBER may be a global phenomenon for bringing ease and comfort to millions of people worldwide, it’s not the first of its kind to actually spring up in Cambodia. Previous startups have given this a go. These include Choice Taxi, Exnet Taxi Cambodia, PassApp Tax, and iTsumo. But the company doesn’t seem any bit fazed.Just recently, David Van – Managing Director of Bower Group Asia – brought UBER representatives to meet with Cambodian Minister of Public Works & Transport Sun Chanthol to discuss proposals for their future launch. Although no details have been given yet regarding the official date of the launch, it looks like the company is in full gear to do it soon because this news comes only a two months after UBER’s first meeting with the Cambodian Minister of Commerce Pan Sorasak.UBER CambodiaThe company may be coming in full force, but there are also concerns of UBER eventually collapsing, especially with news of them having pulled out from China in exchange for a 20% holding in its competitor’s company, Didi. CNN also reports that UBER is pulling out from Denmark as well. If that’s any indication, then UBER may have troubles with the Cambodian Market.Despite this, a post from the ministry of Commerce Facebook page says “Mr. Chan Park and Mr. Brian Shroder, the representatives of American worldwide online transportation network company called ‘UBER’ said that they were very impressed with Cambodia’s new market. But at the same time, they need to understand more about economic situation, people’s living standard, and other challenges first.”How will people accept UBER?According to Masahito Ambashi, Economist for the Economic Research Institute for Asean and East Asia, mentioned “UBER is famous internationally, including in Cambodia. Consumers may try its services, as they are different from those of locals. If such trends occur, a bandwagon effect could be expected.” And this could ultimately lead to UBER’s success.In line with this, Ambashi adds that “more wealthy middle-income groups – which can afford to enjoy service consumption – are certainly emerging in Cambodia.” This means that the number of people who can afford UBER rides are also increasing.The other question remains, can Uber challenge the local tuk tuk market? Tuk tuks are everywhere in the major cities of Cambodia and are never far away from people in need of transportation for very low prices.The great thing about emerging markets is its potential for growth. But along with it comes the risks investors have to take because its regulations and laws are not fully developed yet. Although relatively small, Cambodia’s real estate market scene is filled with industry-related events. It is that time of the year again when developers get the chance to see (or not) the payoff of their efforts and work, reassembled in the form of an award. For the second year in a row, the PropertyGuru Group is organizing the Cambodia Property Awards, which is set to be the biggest and most exclusive real estate awards event in the Kingdom.Last year, the debut event saw over 300 guests and VIPs, and was broadcast live on CTN’s Cambodia News Channel.Bringing together all the biggest developers in town and award them without upsetting anyone must be not an easy task. In order to find out more Realestate.com.kh met with Mr Terry Blackburn, Managing Director of PropertyGuru Asia Property Awards.The Cambodia Property Awards was launched in late 2015 as part of the then 10-year-old Asia Property Awards programme that began in Thailand in 2005 (which later on expanded to other seven countries across South East Asia and in China). Cambodia held its first gala dinner in February 2016, becoming the latest addition to the awards programme last year, which Terry described as “one of the last pieces of the puzzle.”Mr Terry believes that due to the Awards’ long history and earned credibility, they are in the right position to set a benchmark for quality within real estate, on a regional level.Developers of contemporary projects that will be completed within the next 18 months are now eligible to apply. Currently 22 categories are set for this year and each project will be evaluated by an independent panel of judges formed by top experts of the industry. The panel will be supervised by BDO, one of the world’s largest accounting and auditing firms, to ensure full transparency and conflict-free evaluations. But how can the Cambodia Property Awards set the benchmark for quality?Mr Terry explained that each project goes through a thorough onsite inspection, where the panel of experts reviews the viability of the construction and their quality, based on a verified checklist that covers different crucial aspects. This process – from nominations to choosing the winners – takes up to six months. Every real estate development is scrutinised, giving an extra assurance to future buyers. More importantly, based on existing rules of the Awards, developers who eventually win but fail to complete their projects by the established deadline, risk to have their award withdrawn. This gives assurance not only in terms of quality and design of a given development, but as well as its economic viability.Due to his familiarity with other Southeast Asian real estate markets, we have also asked Mr Terry’s thoughts on Cambodia compared to other countries where the Awards operate in, as well as the possibility of a real estate bubble: “In the upcoming months , when majority of the developments will be completed, we should have a better overview of what is being sold for occupation and what for investments. Of course a healthy market implies a high number occupants rather than speculative investments; if this will be the case for Cambodia, then a new wave of investments will come in, if not it might take a while before these projects are sold or rented out. In the latter case however, I do not see an imminent drop in price, since developers often work on tight margins.”When comparing Cambodia to other countries in Asia, Mr Terry stated: “I must say that Cambodia is small but certainly a fast-moving market, with plenty of room for everyone: I particularly see a big potential in the affordable housing, given that the Cambodian finance sector is more consolidated compared to other countries, such as for instance Myanmar, where all the payments still happen in cash and a proper mortgage system is not yet in place.”For developers who are interested in entering their properties in the Cambodia Property Awards, nominations will close on 27 January and entries on 3 February.Find more  real estate news on Realestate.com.kh
