It allows investors to feel a familiarity they may otherwise miss when they transact with other agents. Among the leading languages in Cambodia are Khmer, English and Chinese. The more languages you know, the more sales you can make.CommunityDeveloping relationships in the industry is one of the biggest contributors to the successes and failures of real estate sales agents and agencies all over the world. Without good networking skills, you lose the potential client base that will organically come through referrals. So, this means that you not only develop relationships with the clients. It also means that you should develop a deeper connection with colleagues, other agents and organizations. This is why Evengroen suggests all Cambodian agents shouldย join the CVEA - which is a big group of real estate companies registered with The Ministry of Economics and Finance.Being part of a community like this gets you the chance to learn from like-minded individuals who are willing to support you and who are also seeking to improve the industry conditions itself. This is the sentiment shared by Evengroen during the interview. He says that who you are the first time people meet you will last until they decide to part ways with you. So, you want them to feel the support you are willing to offer them. A bad impression can somehow be offset with consistent follow-ups though. And whether youโ€™ve made a bad or good impression, follow-ups remain one of the best ways you can close the deal. Just be mindful of the frequency so that it wonโ€™t reach a point where clients are inconvenienced by it.ConfidenceBeing a personal and professional success coach, Alex Evengroen believes that agents should first and foremost believe in themselves. They have to dare to be different. He says that "if you copy other people, no problem. But then you're one of them and you're the same.โ€ And while itโ€™s important to mould ourselves in the image of a successful person, our differences will serve as our personal and even professional marketing tool. He states that we must make a conscious choice to be confident. "So, if I don't believe in myself, why should you believe in me?โ€He further emphasizes that confidence makes other people confident that you will support them when they need it. In 2007, Camko City and three projects of De Castle, along with a few other projects, started off-plan in the northern part of Phnom Penh, being introduced into the capitalโ€™s housing market for the first time, with 1,700 units launched for presales off-plan that year. And it was, indeed, a nascent market at the time but still interesting enough to attract local and especially foreign buyers who speculated for returns at the resale market.Now it is not a nascent market anymore. It has been around for almost 10 years, with lots of condos situated across the capital, especially in the central district of Chamkar Mon, or northeastern parts of Phnom Penh.Today, a newly-released Century 21 record says there are in total 110 condo projects with 148 individual buildings, both finished and ongoing, or 37,570 units slated through to 2020.Supply has shot up remarkably within these two years, while the market goes with a mix of tones โ€“ a today challenge and tomorrow blessing. ย That is said, current excessive supply is not only a pressure on the ability of the market to absorb in the short term but also a possibility that the market will reach equilibrium where buyers enjoy in the medium to long run.For the market challenge, there two key factors to look at: sale-to-stock ratio and market absorption rate.First, according to the Century 21 report, during the first half of 2016 saw a dramatic presale launch, about 13,300 of new units, into the capitalโ€™s condominium market but only 13 percent of them sold, compared to 18 percent and 31 percent in the same period in 2015 and 2014, respectively. Second, absorption strength in the first six months of 2016 was 3.8 years, slower than the market absorption rate in 2015, which was 2.8 years."Itโ€™s nothing surprise because the supply early this year rose too high for the current demand to catch up, said Chrek Soknim, executive officer of Century 21 Mekong.A market slowdown has been mainly dragged down by a huge number of new units added to stock last year and during the first half of this year, offering a hard time for the demand to take up in the short term, reads the same report".Touch Samnang, president of OCIC, which is investing in condominium project Olympia City,ย acknowledged, telling the Post that condo sales early this year has plummeted due to too muchย supply, adding that before most developers focused on โ€œforeign and upper class market, butย today they have turned around towards the average crowd.โ€Too much reliance on international market, further, contributes to this market challenge, for local affordability and trend are not strong enough to bolster the market growth. In 2014, a Park Cafรฉโ€™s consumer survey among Phnom Penhโ€™s active professional population showed only 1 percent earned a threshold of US$2,001 to US$5,000 per month and 6 percent earned a threshold of US$1,001 to US$2,000 per month.According to a Vtrustโ€™s housing market survey in 2015, about 54 percent of the respondents said they expected to buy homes at prices within a range of US$30,000 to US$70,000 per unit, while today only around 40 percent of condo units in stock are with prices lower than US$70,000. However, only 9 percent of the local expectant buyers said they would choose to buy condos.On the other hand, an excess of market supply today could also potentially be a blessing for the capitalโ€™s condominium market in the medium to long term, be it 3 to next 6 years.It is an advantage because when the supply is widely available in the market, it offers numerous opportunities for expats and foreign investors who come to work and live in the capital, since some condominiums offer mixed-use options along with amenities that ease their ways of life.Kuy Vat, chairman and chief executive officer of Century 21 Cambodia, supports the viewpoint, saying, โ€œWhen business people or investors want to come for businesses in Cambodia, what if we donโ€™t have sufficient housing supply along with amenities

Despite the law from 2010 that states that foreigners are only able to buy or rent propertiesย above the ground floor and only up to 70 percent of properties, many foreign nationals andย investors have still been able to purchase landed properties through soft titles across variousย districts of Cambodia for many years passed.However, as a result of the Ministry of Land Management, Urban Planning and Constructionโ€™sย (MLMUPC)ย recent decision to enforce long-standing soft title ownership regulations, all khansย (districts) of Phnom Penh will stop allowing the processing of titles under a foreignerโ€™s name.What is a Soft Title?A Soft Title is a Cambodian land title that is recognized at the local government level. Soft titlesย are provided by the local Sangkat or District office and are not registered at a national level โ€“ย but are still considered a possessory status. A Hard Title, by comparison, is recognized at aย National level.The majority of property transactions still occur with soft titles in Cambodiaย because it is an easy way to avoid ownership transfer taxes and fees. A Hard Title, byย comparison, costs around 4% of the property value to create or transfer ownership.Under theย constitution, however, these soft titles are not legally available for non-Cambodian nationals.No more Soft Titles for Foreigners:Up until now the Ministry of Land Management, Urban Planning and Construction have turned aย blind eye to the many Khans and Sangkats below their authority issuing soft titles to foreigners.In a recent announcement, however, this precedent has been totally stopped in Phnom Penh.Ownership of Land in Cambodia via Nominee:Nevertheless, there is still a way for foreigners to own landed property in Cambodia throughย nominees.What is a Nominee Structure?Simply put, this structure lets the foreign investor sign a trust agreement in partnership with theย land holder. The land is then put into mortgage, and then leased to the foreign investors.ย This is an inexpensive way to โ€œownโ€ a property and the land beneath it, or at least have totalย control over that property.Itโ€™s quite simple to implement this nominee structure: You only need four โ€œsecuritizationย documentsโ€ which is the mortgage agreement, loan agreement, lease agreement, and securityย agreement.Having these four documents will guarantee that you have control over the property, andย security against the nominee trying to liquidize your asset without your consent.Grant Fitzgerald of IPS Cambodia notes the structure of the nominee is economical, fast, and effective for foreign buyers.Risks of Buying via a NomineeEven with proper legal protection, a nominee purchase actually disregards the constitutionalย prohibition on direct ownership of property by foreigners.Nevertheless, it is possible and it does work in practice. But always seek advice from aย registered Lawyer and an experienced real estate agency.How the Nominee Structure will Affect Buying and Selling:There are two possible scenarios, given that there is now strict enforcement from the MLMUPC.ย The correct course of action will depend on how enforcement is managed in practice in theย coming months.Transfer to Nominee on Sale:One scenario would allow foreign investors who currently own landed property to keep it in theirย name for the time being, but will be forced to transfer to a nominee before they can sell orย transfer the title. This essentially means delaying the inevitable. But if the MLMUPC do notย enforce strictly, it may be possible for the time being.โ€œThe new enforcement will not likely directly affect foreigners currently owning soft titles until itย comes time to sell,โ€ suggests Desmond Yap of Yong Yap Properties. โ€œIf Daun Penh follows theย precedence of 7 Makara which did allow foreigners to purchase flats in previous years,ย foreigners who have properties under their name can still live in it and rent it and are under noย pressure to sell. Just when they do eventually sell, it has to be in the name of a Khmer national.โ€Transfer to Nominee Immediately:The second scenario is where current foreign owners of these types of soft-titled properties willย be forced to sell them, or transfer the title to a nominee immediately. If the MLMUPC decide toย enforce the regulation so strictly, the foreign owner will be able to transfer the property toย nominees, with the proper protections in place.In these cases, getting a lawyer would be the best option. Yap notes that โ€œthe worst caseย scenario is that they will force you to sell the property โ€“ though if this happens, you can justย transfer the property into a nomineeโ€™s name with the protection of a trusted lawyer.โ€How will this Influence the Market?As a result of this, sales in soft titled properties are expected to slow down in expat hotspotsย around Phnom Penh as necessary adjustments are made by agencies to accommodate theย stricter enforcement of the law. But the price is much higher also. Where to buy, however, willย depend on the demand of customer - are they aiming to build a condominium, office or flat house development? Whatever they choose, they need to go to an area where the buyers are demanding these properties. For condo buyers and developers, the best suited location would be central Phnom Penhย city,ย becauseย the target market are the wealthy, the inner-city workers and those demanding aย higher standard of living. In addition, offices buildings or companyย headquarters need to be placed on mainย roads such as Norodom Boulevard, Monivong Boulevard, and Kramoun Sar (114) Road. This means demand in these areas for commercial properties remains high. This week, Realestate.com.khTV invited Hun Chansan, director of Re-Edge Architecture & Design, to our studio to speak about the Cambodianย Architectureย scene. "Hun Chansan is a registered architect, a member of Board of Architects Cambodia (BAC) and Cambodian Society of Architects (CSA).ย Chansan graduated with a Master in Architecture from Northeastern University Boston, Massachusetts and returned to Cambodia in 2009 after spending more than 15 years in Singapore and the United States. His first job in Cambodia is the Faculty Coordinator and lecturer of Architecture and Design at Limkokwing University of Technology Phnom Penh campus. Chansan is also a visiting professor at Pannasastra University School of Architecture and Design in which he shares and inspires about Design and Concept with his students. Since 2011, Chansan established Re-Edge as a continuation of his Master Degree Thesis project called โ€œRe-Edging Retailsโ€ where the architectural approach is a dialog between a building and its environment. Since then, Chansan has directed the design completion of many types and scales of numerous projects." Why did you decide to study architecture? When I was in Singapore, I spent so much time drawing. Then, there was a teacher who noticed my talent, so he advised me to major in architecture. When I pursued my degree in the USA, I decided to follow his advice, majoring in architecture. ย Thanks to the in-depth study and practice I had there, I got to understand more about this major and came to realize that architecture has enormous influence on peoples' daily lives. Since then, I have followed this path. Who isย theย person you admire most? There are many people who inspired me. I am luckyย I had chance to study abroad and observe numerous (architectural) achievements. As a matter of fact, those who major in architecture need to be really good at observing other artworks. So, I went to Europe and the United States to learn more about that. Mr. Louis Khan, a US architect, heavily emphasizes his project on choice of location and shows greatย creativity in maintaining its natural elements and fresh air. His innovation still looks new today. Mr. Le Corbusier is a French architect with very high creativity. In the past, his ideas were rejected. But he made himself recognized and has continued to impress everybody until today. He is also the teacher of famous Khmer architect Mr. Vann Molyvann. Do you have your own style ofย architecture? Talking about personal style, I donโ€™t specifically own one. Naturally, we have our own characteristics. However, I donโ€™t really focus on making sure my style is always pronounced. Instead, what I pay more attention to is theย location of building and customerโ€™s demand. Currently, my company has obtained different projects such as Borey, Villa, and Condominium projects around Phnom Penh. What do you think about the future of architecture in Cambodia? The architectural sector in Cambodia will experience more development in the future. We believe that the increase in the competition level and higher standards of education in the local market will bring about an increase in competency and creativity in the next generation of Khmer architects. In the meantime, modern technology helps a lot in expanding local knowledge andย Khmer's travelling internationally. Every industry has its stories of successes and shortcomings. The real estate and property investment industry in Cambodia has certainly had lots of those - and has developed a lot alongside its victories and it's rising from past failures.This is the same reason why it is regarded as the rising tiger of Asia: Strong in its approach and wiser with each controversy and distress, the property and land markets have seen significant growth in the past years. But there remains challenges that it must overcome to reach its maximum potential.In a speech for fellow professionals and enthusiasts in the Real Estate Market & Outlook Conference (REMOC) 2016, president of CVEA and CEO of Khmer Real Estate, Mr. Kim Heang, addresses some of the challenges for the land, condo, borey, factory and warehouse markets.Should Foreigners Be Allowed to Buy Land in Cambodia?He states that Cambodia is fortunate enough to have laws and policies in place that restrict foreigners from buying land. Unlike countries that do not, Cambodia is reaping the benefits of this policy through stable investment opportunities for locals. Heang explains that if foreigners are allowed to buy properties in Phnom Penh, the whole of Phnom Penh would soon become a giant Chinatown, since the Chinese represent the largest population of investors right now in the area. He adds, "I don't want to be the last Cambodian to live in Cambodia." But even if laws to allow foreigners to purchase land may be possible in the future, Heang clarifies that now is not the right time for that. Where to Invest Now?Heang suggests that if you are looking to buy land for investment returns right now, buy from areas like BKK1 that have 25 years of reliable investment history and established amenities like hospitals, schools, market places and offices. This area is perfect for buyers looking for residential spaces. But if youโ€™re willing to wait and place your money for longer and for a bigger return, and plan on doing resale in the next five years, properties in areas like Toul Kork might show better potential for that purpose. He also mentions it is cheaper to invest in condominiums being built in Toul Kork now, because more established areas like BKK1 are heavily influenced by the very high land prices.Heang adds that people looking for investment returns in the next ten years would be best to buy properties outside Phnom Penh itself, in the outer districts, or up to 15 to 20 km away from it. Condo Oversupply?At present though, there are around 20,000 condominium units expected to reach completion by 2018. While there is a concern that there may be an excess of units, Heang suggests that the condominium market will have plenty of demand in the coming years since the Phnom Penh population is expected to rise rapidly as well. And though foreign investors are not allowed to buy land from Cambodia, if the government can get foreign investors interested in Cambodia, it would not be unreasonable to double or triple the amount of units that Phnom Penh already has to offer and still find sufficient demand. This can be achieved through friendlier and more efficient investment policies being put in place by the Government. Property Development Advice:But Heang notes that for property developers, the condo market is now becoming highly competitive and condominiums may not remain practical for long-term living in the city because of the traffic and congestion issues growing in central areas. For that reason, Heang suggests that developers should consider moving to areas on the edges of the city and supplement the local market demand for more landed Borey projects. Preselling also becomes an issue in terms of condominium developments because many developers now cannot afford to buy the land for development outright - so instead loan for this land payment from financial institutions. While itโ€™s not bad to get a loan for the development, many investors are unable to reach their target market during presales and get the necessary support to start construction- as they donโ€™t have upfront capital reserved for construction. Heang advises against allowing this kind of practice throughout the industry due to the potential pitfalls this can cause.Industrial Property Still Strong:But while the condominium market remains unpredictable, industrial spaces such as factories are becoming even more popular for investors in Cambodia because of the relatively low minimum wage for workers that still exists in the Kingdom. Investors have also become wiser, transferring their factories to less expensive areas to save on overhead costs.Heang concludes by saying, โ€œthe future of real estate in Cambodia? What is the future? Nobody knows. No one knows about the future." He says that problems are everywhere and it is important that you have a solution-based mindset. In a highly volatile industry where even the smallest problems can lead to the biggest changes, professionals in the industry must be able and ready to adapt.

As a result of the Ministry of Land Management, Urban Planning and Constructionโ€™s (MLMUPC) decision to enforce long-standing soft title ownership regulations, all khans (districts) of Phnom Penh will stop allowing the processing of titles under a foreigner's name.Previously, many khans such as Daun Penh have openly allowed foreigners to take possession of soft tiles on landed properties, despite it being a contradiction to the 2010 law on providing foreigners with ownership rights in private units of co-owned buildings.Desmond Yap, managing director of Yong Yap Properties, an expat-focused agency based in the Daun Penh/Riverside area, says, โ€œAs we understand now, throughout Phnom Penh, foreigners can only own condominiums as stipulated in the 2010 Foreign Ownership Law (the Strata Law). The purchase of townhouse flats can only be done through a nominee or company structure.โ€Want to know what a Soft title is? Learn More about Foreign Ownership in Cambodia...In order to better implement the 2010 Foreign Ownership Regulations, the MLMUPC issued a notification letter on May 25 instructing chiefs of all 12 khans in Phnom Penh City that from June 13 onwards, the transfer of possessory rights to a foreigner is only legal if the property subject to the transfer is on or above the first floor; and the property being transferred into the foreigner's name exists in a co-owned building constructed with the proper construction permit issued by the relevant government authority.This means that any co-owned building constructed without the proper construction permit will not be considered eligible for foreigner ownership, and paperwork signed by a chief of any khan in Phnom Penh City relating to the transfer of possessory rights under a soft title to a foreigner will not be legally binding.ย Following this, Khan Daun Penh officials announced in early June that the sangkat (commune) will no longer transfer soft titled property into a foreignerโ€™s name.Grant Fitzgerald, general manager at Independent Property Services (IPS) Cambodia, said that โ€œthese laws have always been there, they are just now enforcing them across the board.โ€โ€œThis new announcement for Daun Penh follows on from a similar change made in Khan 7 Makara late last year which saw a flurry of activity as foreigners who held property in their own name sought advice and solutions to ensure that their property was secure,โ€ Fitzgerald added.However, the notification letter sent by the ministry on May 25 did not specify the legal consequences to the co-owners of the building if a transfer of possessory rights is made to foreign co-owners when there is not a correct construction permit in place. Nevertheless, this appears like a step forward in strengthening the practice for foreign ownership laws in Cambodia - as it is targeting developers without construction permits. ย The new enforcement will not likely directly affect foreigners currently owning soft titles until it comes time to sell, suggests Yap.โ€œIf Daun Penh follows the precedence of 7 Makara which did allow foreigners to purchase flats in previous years, foreigners who have properties under their name can still live in it and rent it and are under no pressure to sell. Just when they do eventually sell, it has to be in the name of a Khmer national.โ€Further, Yap notes that โ€œthe worst case scenario is that they will force you to sell the property โ€“ though if this happens, you can just transfer the property into a nomineeโ€™s name with the protection of a trusted lawyer.โ€An overseas investor of Yong Yap Properties said the crackdown was a โ€œbit of a surprise, but not totally unexpectedโ€.โ€œI thought it wouldn't come for a while. Anyway, at least I am glad I bought one before the change although it may be harder for me to sell it now."The new policy, according to Yap, may slow down sales in the short-term in Daun Penh, though the rental market will not be affected. In fact, Yap explains, โ€œRental prices may increase in the future.
